The most significant change involves the elimination of permanent alimony and the introduction of "Durational" alimony. Under the updated regulations, durational alimony may not be awarded following a marriage lasting less than three years. Furthermore, once granted, durational alimony may not be modified except under exceptional circumstances and may not exceed the length of the marriage.
The concept of marriage lengths has been redefined under the new regulations. Short-term marriages are now classified as 0-10 years, moderate-term marriages as 10-20 years, and longer-term marriages as 20 years or more. These distinctions play a pivotal role in determining the nature and duration of alimony payments.
Durational alimony is subject to specific limitations based on the duration of the marriage. It may not exceed 50% of the length of a short-term marriage, 60% of the length of a moderate-term marriage, and 75% of the length of a long-term marriage. However, under exceptional circumstances, the court may extend the term of durational alimony with a clear and convincing evidence presentation.
The amount of durational alimony is now calculated based on the obliges reasonable need or an amount not to exceed 35% of the difference between the parties' net incomes, whichever is less. This calculation excludes spousal support paid pursuant to a court order in the action between the parties.
The amendments also address the impact of adultery on spousal support determinations. In cases where a supportive relationship exists between the oblige and a person not related by consanguinity or affinity, the court is mandated to make written findings of fact to determine the nature of the relationship and to what extent it should influence the reduction or termination of support, maintenance, or alimony.
